The FCPE has alerted the various authorities since the start of the 2005 school year about the pricing of the cafeteria for several hundred students who are not residents in Nice. Indeed, the meal prices for children not domiciled in Nice rose from 2.59 euros to 6.20 euros in primary school and from 2.33 euros to 5.94 euros in kindergarten. In a letter dated November 24, 2006, the Departmental Directorate for Competition, Consumer Affairs, and Fraud Prevention stated that the price charged by the city of Nice “was indeed in violation of the provisions of decree 2000-672 of July 19, 2000.” This decree (see further information) specifies: “the establishment of cost-sharing for operating expenses is only due when schooling in a public school in another municipality is unavoidable or when the mayor has given his consent.”
Some programs make it mandatory for children to be schooled in the city of Nice. The FCPE considered it abnormal that the parents of these children were subject to increased cafeteria rates.
The municipality of Nice has committed to reimbursing the excess charges to the families who request it by providing proof of the amounts actually paid during the 2005/2006 school year.
