The Parc Impérial Neighborhood Committee is filing an appeal against the installation of a mobile phone relay antenna on a gymnasium (Palmeira)!!

On September 9, 2008, ORANGE France submitted a construction permit for a mobile phone relay antenna at 21 Caffarelli Street. The Parc Impérial neighborhood committee mobilized the residents, and the project was abandoned. During a public meeting at CUM on January 6, 2009, the deputy in charge of the “Niçoises Hills” territory, Olivier BETTATI, stated: “… We are trying to find another installation site, higher and further away from residential areas. There could be a possibility at the center of St Philippe Square. We’ll see if the coverage is good. And if it doesn’t work, we’ll see each other again…”. Yet another unfulfilled promise!

Today, a new project of two antennas is announced on the same Caffarelli Street, just a few steps away from the previously selected site. A construction permit has been filed for the “installation of a tube antenna supporting two antennas” at 9 St Philippe Path.

In a letter dated December 3, 2010, Hervé CAEL, president of the Parc Impérial neighborhood committee, has just filed an amicable appeal against this construction permit and is asking Mr. Christian ESTROSI, Mayor of Nice, President of Nice Côte d’Azur, to join the residents’ request and suspend this mobile relay antenna authorization.

Given the current knowledge about the health risks related to the installation of relay antennas, the constitutional precautionary principle dictates not to install two mobile relay antennas above a gymnasium that accommodates the children of our neighborhoods (Palmeira Gymnasium). In its ruling of July 18, 2010, the Council of State judged that the precautionary principle is “applicable” to telephony relay antennas and urban planning law.

Hervé CAEL is calling for an information and consultation meeting with the residents regarding this mobile relay antenna installation project.

ORANGE FRANCE has also been sent this letter to the Mayor of Nice as an amicable appeal.
