Getting a fine: pay or contest?

Latest News

Sometimes, one finds unpleasant surprises in the mailbox: upon opening the mail, you might discover a fine. But before you rush to the post office to pay it, you need to make some assessments. The immediate and full payment of the fine is, in fact, an irreversible process, which implicitly acknowledges that you committed an offense, are paying for it, and therefore also sacrificing points on your driver’s license. However, everyone has the right to contest a fine before paying it, and to do so, specific procedures must be followed.

The first fundamental aspect to consider if you want to contest the fine is the respect of the deadline: for a standard fine, it must be done within 45 days of the notification being sent, a period extended by an additional 30 days in the case of an increased fixed fine.

Secondly, the deposit must be paid, as illustrated in the blue section of the final document. The same section, which is the exemption request form, must be completed and submitted to the prosecutor, also online if you prefer.

Only people in particular situations, for example, if the disputed vehicle has already been stolen, or has been donated or gifted, are exempted from paying the fine. Exemptions are also possible if the holder of the fine is not the same as the vehicle holder, or if the holder was not driving the car in violation.

For all fines related to exceeding the speed limit on a road, running a red light, failing to maintain a safe distance between vehicles, the payment of the fee must be made, and within the deadlines indicated above, otherwise the appeal will be rejected.
