The deliberation of the TGI appears at first glance to be a Pontius Pilate-like sentence: It thus gives reason to the Nice City Hall, which opposes the occupation of the former Aigle d’Or premises by the CGT unionists and, at the same time, states that once the city of Nice has been able to “complete the works,” the CGT should “rejoin the board of directors of the Bourse du Travail.”
However, since the CGT had demanded its reintegration into these premises and had occupied them following the Mayor’s refusal to respect the agreement between the two parties, the union’s position is thus strengthened in its right.
That said, we would suggest to both parties to stop these futile efforts that do nothing but pull them away from reaching a consensual decision.
The statements below are a fine example of lexical contortionism, even a demonstration of grammatical acrobatics.
But what’s next? Everyone talks about wanting to go in the direction of the general interest. The statement would be even more interesting if actions could follow.
To Mr. Mayor, can we remind you of the Jesuit motto “suviter in modo, fortiter in re”?

“I take note of this decision which condemns the departmental CGT to vacate the premises within 3 days.
I hope it will lead the departmental CGT to resume dialogue as I have persistently tried to do over the last two months.
Once again, I wish to call upon the departmental CGT leaders for dialogue and remind them that my door remains open. I hope that in the very near future, CGT 06 will accept the proposals I have made to them so they can continue to conduct their union activities peacefully, and simultaneously, that we can rehabilitate the Aigle d’Or, the Communal Palace, and the Capitole in line with the general interest project adopted by the Municipal Council on June 25.
I have always had great respect for the unions, and I deeply regret this situation of deadlock. Today, I hope for progress that aligns with the general interest.”

It is with great satisfaction that I learn of the decision of the Tribunal of Nice.
The court instructs “the city of Nice to continue the works initiated according to the prescriptions of the municipal security commission and in accordance with their contractual purpose…”.
By asking the Mayor of Nice to meet his commitments (works and the return of the CGT to the Aigle d’or Building on Saint Franรงois square after the completion of works), the Tribunal of Nice reiterates the law against the mayor’s arbitrariness.
This judicial decision confirms the validity of the CGT’s position. A decision that does not oppose the enhancement of the heritage of St Franรงois square.
Now it is up to Christian Estrosi to prove that his sudden (May 3, 2012…) determination to initiate a major renovation of St Franรงois square was not solely motivated by his desire to see the CGT leave this square…
