Nice Premiรจre: Mr. Rudy Salles, what is your position as a Deputy on the DADVSI bill?
Some, perhaps a bit naively, imagine that by endlessly extending measures of protection allegedly inviolable, one could eventually lock down all private copy exchanges through constant monitoring of internet users’ communications.
For me, this is not feasible… And then there are those who ask that once a flat fee for access is paid, all exchanges should become lawful, even if it should harm the remuneration of authors and creators. I am no more in favor of this thesis than the first.
Nice Premiรจre: What would, in your opinion, be the best solutions for managing copies and file exchanges?
I advocate for a legal offer system that is easy, quick, affordable, and user-friendly which directly compensates creators, while the exercise of the right to private copying would result in the payment of a fair compensation. This is the model I defend.
For me, private copying is a fundamental right, not an exception.
That’s why I am not in favor of a committee of experts deciding on it. It should remain within the legislature’s purview. It is legitimate that this right be accompanied by compensation, and I believe not all avenues for ensuring this have been explored, due to the declaration of emergency made by the Government. Parliament was denied the right to fully consider and exchange views with the Senate.

I am mostly aware of the political-media scandal that surrounded the creation of this site. The internet users whom I consulted around me during the bill examination only remember that…but did not know this site! So I wonder what the creators’ intended purpose was?

Ask those who, like you, create websites all day long. They will all tell you that this price is not justified.
Nice Premiรจre: How far are the discussions at the National Assembly?
The debate continues from Thursday night to Friday. This evening (Thursday), we are only up to article 14… My colleagues, UDF Deputies, Jean DIONIS, Pierre-Christophe BAGUET, and even Franรงois BAYROU have filed several amendments based on the ideas I mentioned earlier.
Nice Premiรจre: Do you think a consensus might emerge soon?
The government declared an emergency on a text dating from 2001. Then it filed amendments that completely reshape the text during the session.
If they wish for a constructive debate that leads to a consensus, the national representation needs to regain its serenity, and the urgency must be lifted. I am not convinced of the Government’s intention to seek this consensus.
Nice Premiรจre: Finally, what would be the ideal solution for you?
Our reference model is simple: the existence of a guaranteed legal offer; the right to private copying combined with fair compensation, which could take the form of a flat rate collected via internet service providers. This is my program for sustainable development and defense of cultural diversity on the internet.
