After the publication of the prefectural decree of the Alpes-Maritimes, individuals appealed to the summary judge of the Administrative Court of Nice. After a first rejection of their request, the individuals appealed to the Council of State.

The decision has been made: the Council of State rejects the request aiming to suspend the decree of the prefect of the Alpes-Maritimes, which conditions access to six shopping centers on the presentation of a health pass.

In a statement published this Monday by the Council of State, the judge considers “that this obligation serves a public health objective” and that “there are numerous shops nearby” where people without a health pass can obtain essential goods. For the Council of State, “the contested decree has not caused a serious and manifestly illegal infringement on the invoked fundamental freedoms.”
