The Administrative Court of Nice suspended this Monday the decree by the city’s mayor, Christian Estrosi. He wanted to prohibit seasonal rentals in the municipality to reduce the epidemic risks linked to an influx of tourists from February 6 to 20.
This Monday, the Administrative Court decided otherwise. It upheld the appeal of the Professional Union of Tourist Rentals (UPLT). The epidemic risk was not demonstrated. The mayor of Nice intends to challenge the decision of the administrative court before the Council of State. “The same jurisdiction that recognized my right, even my duty to act in the face of the exceptional circumstances that Nice experienced during the review of the appeal against the curfew or the wearing of masks, now holds the opposite view, considering that since the Prefect did not intervene, the situation is not exceptional and does not justify exceptional measures! What a peculiarity! Go figure! It’s better to rely on the Council of State. We will appeal this decision.”
