The “anti-bivouac” decree put in place on October 9 in the heart of the city of Nice by its mayor Christian Estrosi has been suspended by the Administrative Court of Nice, announced yesterday, the League of Human Rights, which had filed the appeal on October 18 in association with the MRAP and AdN of Teresa Maffeis.
“The League of Human Rights of Nice is delighted with this decision, which is a victory against attitudes of rejection towards others that unfortunately tend to become the norm in public debate,” it reacted in a statement.
The “anti-bivouac” decree primarily involves granting increased powers to the municipal police, allowing them to issue fines and conduct identity checks to bring irregular individuals to the national police.

“I acknowledge this decision even though I am surprised by the lack of motivation on the part of the jurisdiction.
From reading the order, it seems that the Court places the freedom to come and go on an equal footing with the abusive and prolonged occupation of public space. Therefore, this decision seems questionable to me, and I have already asked our counsel to file an appeal in cassation against this decision.
Meanwhile, I will issue a new decree on Monday allowing the Police to intervene again against illegal occupations of public space that hinder free movement.”
