The controversies between the prefecture, the president of the departmental council, and the Roya associations regarding assistance to minors have prompted a firm statement from UNICEF, which reminds of the obligations involved.
Seen as outlaws, dangerous accomplices to smuggling networks by some and humanitarians by others, these activists find support for their actions through this statement, which addresses the issue without demagogic positions.
Concerned about the situation of minors attempting to cross the French-Italian border every night, UNICEF France expresses strong concern about unaccompanied minors (UAM) crossing the border, who are particularly vulnerable to risks of violence, exploitation, and trafficking on their journey. They are sent back to Italy by the Border Police just like adults, without their status as children needing protection being considered.
UNICEF France reminds that the obligations contained in the Convention on the Rights of the Child prevail over any other considerations, bilateral agreements, and in all situations.
The French-Italian border cannot be an exception. The best interests of the child must be the guiding principle of all decisions and actions undertaken by the French authorities.
UNICEF denounces the systematic expulsion of UAM at the border by French authorities, which exposes them to numerous dangers and increased risks of violence, ignoring the international commitments ratified by France when the absolute priority should be to protect them.
UNICEF calls on French authorities, both local and national, regarding this situation that subjects minors to the same treatment as adults and distances them from any protection.
As reminded by the Committee on the Rights of the Child (General Comment โ 2005), “the obligations of a State party under the Convention apply within its borders, including towards children who come under its jurisdiction while attempting to enter its territory”.
