Juliette Mรฉadel, the Secretary of State for Victims, indicated that the first compensations related to the Nice attack that occurred on July 14, 2016, would take place as early as this week.

“The people who need compensation will be compensated. Obviously, the State will stand by the victims, all the victims (…). The fund will receive the necessary funding to compensate the victims who will be identified. This is extremely clear, there will be no lack of resources for this fund,” she affirmed while visiting Nice this Tuesday.

She notably indicated that she had asked “the FGTI to dispatch three people, including two legal experts, who are at the family reception center and are there to identify the most difficult situations, which require urgent support for initial expenses.”

But who is concerned?

There, it is stated that “the Guarantee Fund for Victims of Acts of Terrorism and Other Offenses fully compensates the bodily injuries of injured victims and, for deceased victims, the damages for their beneficiaries.”

Regarding indemnification timelines, it is specified that the Guarantee Fund pays an initial provision no later than one month after receiving the victim’s request to cover initial expenses, and that the Guarantee Fund presents a written offer of final indemnification no later than three months after receiving the documentation of the victim’s damages.

In cases of injuries with recovery without sequelae, the Guarantee Fund sends an indemnification offer based on the submitted medical certificates, documentation of expenses incurred, and loss of income.

In cases of injuries with sequelae, the Guarantee Fund pays one or more provisional indemnities. The Guarantee Fund asks its medical advisor to examine the victim, who may be assisted by a doctor of their choice. When the victim’s health condition is stabilized, the Guarantee Fund sends them a detailed breakdown of the proposed indemnity based on the medical report.

In the case of death, the indemnification offer is sent to the beneficiaries. It includes compensation for moral damages, funeral expenses, costs borne, and economic damages.

Furthermore, specific rights are recognized for these victims. Thus, the inheritances of victims of acts of terrorism are exempt from inheritance tax. Victims of acts of terrorism committed since January 1, 1982, benefit from the status of civilian victims of war. The rights and benefits derived from this status are contained in the Code of Military Pensions for Invalidity and War Victims (grant of a non-cumulative pension, right to free medical care and appliances…). Any victim of an act of terrorism is also considered a member of the National Veterans Office.
