Healthcare workers in the Alpes-Maritimes are fighting against the vaccine mandate.

This is a first for the Alpes-Maritimes: two petitions against the vaccine have been filed with the Council of State by Jérôme Campestrini (a lawyer at the Nice bar).


522 is the number of hospital staff members in the department, gathered within the 06 Health Workers Collective, who have come together to file two appeals with the Council of State through the Nice bar lawyer Jérôme Campestrini.

Among these petitions is a request for the suspension of the decree of August 7, 2021 and its annulment, according to information from the newspaper Nice-Matin. The 06 Health Workers Collective and Maître Campestrini hope to secure a hearing date within 15 days.

Beyond these appeals, it appears that the lawyer from Nice has several other cases to handle. Indeed, about a hundred cases (submitted by the collective) are being processed concerning healthcare personnel who have been suspended from their duties since September 15 due to their refusal to get vaccinated.

These two appeals are based on the law of May 7, 2017 regarding clinical trials of medicinal products for human use and on medical ethics, according to which a person is free to choose whether to receive a treatment in the experimental phase.

Maître Campestrini states in the Nice-Matin newspaper that “Access to employment cannot be conditioned on mandatory vaccination.”
