By Master Cédric Bianchi, Lawyer at the Nice Bar, Walicki Allouche Bianchi Firm – Lawyers in Nice

Under the conditions set forth by articles L. 1237-11 to L. 1237-16 of the Labor Code, the employer and the employee can mutually agree on the terms of the termination of the permanent employment contract (CDI) that binds them. This mutual agreement termination of the employment contract follows a specific procedure: meeting(s) between the two parties, approval of the agreement… It is surrounded by a number of guarantees for the employee and entitles them, under common law conditions (sufficient prior activity, active job search…), to unemployment insurance benefits.
