You have created your microenterprise and your bank is asking for your Kbis? Be careful, the Kbis extract is only mandatory for certain types of microentrepreneurs. You may not be affected. Letโs see what a Kbis extract is, what it is used for, and what type of self-employed individuals need it to conduct their business.
What is a Kbis extract?
The Kbis extract, or K bis, is a document that allows an entrepreneur or a company to justify its registration in the commercial and companies register (RCS) and to prove its legal existence. It is somewhat like the “identity card” of a commercial enterprise. The Kbis extract must be up-to-date to justify the existence and registration of the company. It is issued by the Registrar of the Commercial Court. This document is useful in many situations: for example, opening a professional bank account or purchasing materials from a supplier.
A Kbis extract provides information about the companyโs activity and includes all the details registered with the RCS, such as:
- Name of the registrar of the commercial court (who signed the registration)
- Names (corporate name, acronym, trade name)
- APE code (or NAF code)
- Legal form (SARL, SA, GIE, SCI, etc.)
- Amount of share capital
- Addresses of the registered office and the main establishment, and any secondary establishments in the European Union or in the European Economic Area (EEA)
- Age of the company (duration of existence)
- Date of its creation
- Detailed activity
- Domain name of the companyโs website(s)
- Position, name, first name, birth date, birth town, nationality, and address of the principal manager, of the directors, and of the auditors
- Reference of obligatory authorizations for regulated professions
- Decisions of the commercial court: safeguards, restructuring, and judicial liquidations
This document is actually called an extract K for sole proprietorships (natural persons), which are Individual Enterprises (EI) and their simplified form like microenterprises. The Kbis extract (or K bis) is intended for legal entities, so all other forms of businesses such as EURL or SASU.
Which microentrepreneurs are concerned by the Kbis extract?
A Kbis extract is mandatory only for commercial companies that must be registered in the commercial register (RCS). Therefore, only microenterprises engaged in commercial activities are concerned with the K extract. A microentrepreneur in a liberal profession is not concerned with obtaining this document. However, if they engage in a mixed activity, one of which corresponds to a commercial activity (buying and/or selling), they must then register with the RCS and can thus obtain their microentrepreneur K extract.
How to obtain a K or Kbis extract for your company
Every commercial microentrepreneur receives a K extract when registering their microenterprise with the RCS. If you need a document less than three months old, you can request one after creating your business. You have several options for making this request:
- online via MonIdenum (a service provided by the National Council of Registrars and Infogreffe), it’s free;
- request an electronic or postal mail delivery via Infogreffe;
- request a postal delivery or an in-person collection at the registry of the Commercial Court;
- delegate your request for a Kbis extract to one of the websites offering this service.
