Reform of Territorial Authorities: The Combining of Investment Grants from Departments and Regions is Once Again Possible

A communication from the CROS (Regional Olympic and Sports Committee) Cรดte d’Azur confirms a very good piece of news for the sports association world, which puts an end to a lot of uncertainty and apprehension.

cros-paca.jpgOn November 3, the Joint Committee (CMP) composed of senators and deputies reached an agreement on the bill to reform local authorities.
Two major changes that meet the expectations of the latest ANDES press release (10/25/10) have been made regarding sports:

1- The possibility of combining investment subsidies from departments and regions starting January 1, 2015, which must be provided for in a regional framework specifying the respective competencies and financial interventions of the departments and regions. An upcoming decree will specify the modalities (the initial prohibition as of January 1, 2012, has been removed).
“โ€ฆ in the absence of adoption in the concerned region of the scheme for organizing competencies and pooling services [โ€ฆ], no project can benefit from a combination of investment or operating subsidies granted by a department and a region, except if decided by a municipality with a population of less than 3,500 inhabitants or an inter-municipality cooperation public establishment with its own taxation with a population of less than 50,000 inhabitants.”
As for the combination of operating subsidies, it remains allowed in the areas of culture, sport, and tourism.

2- The minimum participation of the contracting authority for an investment is now 20% instead of the initially planned 30%.
“Any local authority or group of local authorities, the contracting authority of an investment operation, ensures a minimum contribution to the financing of this project, this contribution being 20% of the total amount of public funding for this project.”
The new texts of the CMP will be submitted for vote by the Senate and the National Assembly this week for a definitive vote.

A General Shared Competency on Sport

The senators voted yesterday on the law concerning the reform of local authorities, and the deputies are expected to follow on November 16. Sport is now a shared competency between the municipality, department, and region on the same level as culture and tourism (art 35 IV). We are now moving from a general competency clause to a general competency on sport. As for funding, operating subsidies in the field of sport, as well as culture and tourism, can continue to be awarded without limit to accumulation (art 35 quater). The combination for investment subsidies is subject as of January 1, 2015, to a scheme of organizational competencies and pooling of services, whose objective of clarifying public interventions in the region is to streamline the organization of departmental and regional services. This provision does not concern municipalities with fewer than 3,500 inhabitants and EPCI with fewer than 50,000 inhabitants (art 35 quater).

Sports stakeholders have managed to save the day, and this law allows them to continue as before. In their interest, in the face of an unprecedented financial context, it is now up to them to define how to share this competency. It is a question of their legitimacy and their capacity to mobilize increasingly scarce public resources.
