The UPE 06 defends Lenval and Santa Maria: in favor of maintaining private management

Yvon Grosso, president of UPE 06, wished to speak to the press in the presence of Pierre Costa, president of the Lenval Foundation and the Santa Maria Polyclinic, Dr. Delorme, president of the medical conference of the Santa Maria Polyclinic, and Charles Costamagna, vice-president of the Board of Directors of the Lenval Foundation, following the recommendations of the IGAS at the request of the ARS, which suggested a review of the private legal status retained for the Health Cooperation Group, as defined by its CONSTITUTIVE AGREEMENT.


Yvon Grosso was keen to clarify the reasons why UPE06 would oppose any decision going against this principle.

“The purpose of our meeting today is to express our concern but also our determination to maintain private Pediatrics managed by a competent actor on the Côte d’Azur, namely LENVAL, which for many years has been participating in public hospital service, within a private non-profit structure. The Lenval Foundation can proudly claim three consecutive certifications in 2002, 2006, and 2010 without any reservations or remarks.”

The establishment of a public health institution at the conclusion of the current experimentation would worsen the situation and severely contradict the directions set by public authorities.

This is also a message addressed to the Regional Health Agency and all local decision-makers.

THE CONTEXT OF THE HOSPITAL REFORM: COMPLEMENTARITY AND COOPERATION BETWEEN HEALTH SYSTEM ACTORS

The law on hospital reform related to patients, health, and territories was enacted on July 21, 2009.
The law establishes the general principle of complementarity and cooperation between health system actors.

The modernization of health establishments defined by the law in its broad principles allows, through Cooperation Groups among others, to promote the grouping of public and private skills for better patient care. These groupings also respond to a logic of reorganization of the territorial hospital supply that has been underway for several years.

“We understand this reorganization, which has an economic character but is primarily undertaken for better patient care. As business leaders, we practice daily mergers, absorptions, various groupings necessary to tackle the new challenges presented to us.”

“However, we must remain vigilant about the balance of respective Public/Private roles,” adds Yvon Grosso.

UPE06 WILL OPPOSE ANY DECISION GOING AGAINST MAINTAINING LEVAL’S PRIVATE STATUS

The announcement of a review of the private legal status retained for the Health Cooperation Group, as defined by its CONSTITUTIVE AGREEMENT, cannot be accepted. At the end of the current experimentation, the establishment of a public health institution would worsen the situation and severely contradict the directions set by public authorities.

Moreover, the constitutive assembly of the Group validated the distribution of responsibilities within the GCS by designating the Lenval Foundation to administer the GCS during the experimentation. UPE 06 cannot accept that the “regional administration” reverses this sovereign decision of the assembly.

SANTA MARIA POLYCLINIC MUST REMAIN AT LENVAL

Similarly, the presence of the Santa Maria Polyclinic on the Lenval site is indisputable due to the quality of its services and its perfect harmony with the Lenval hospital for several years. Note that the Santa Maria Polyclinic has just received exemplary certification.

“The regional administration’s desire to request its departure from the Lenval site goes against the modernization of the hospital service favored by the HOSPITAL PATIENTS HEALTH TERRITORIES law and contradicts the grouping dynamic advocated for better care of sick children,” concludes Yvon Grosso.

Following Yvon Grosso’s intervention, Pierre Costa denounces an attempt at a power grab by the administration, and Dr. Delorme shares the concerns of Santa Maria practitioners and protests against the dismantling of Santa Maria, an incomprehensible and unjustifiable measure.

  • Pierre Costa, president of the Lenval Foundation: “As you all know, the regional administration has requested the support of the General Inspectorate of Social Affairs on the matter of the Health Cooperation Group Pediatric Hospitals of Nice.

As of today, the report from the General Inspectorate is still unwritten. In any case, it is not published on the IGAS website.
Nonetheless, “conclusions” in quotes were disclosed as of September 29.
Indeed, after a six-month mission, press releases were issued on September 29 at 5:00 PM before the “conclusions” in question were presented to the concerned establishments… at 5:30 PM!”

“The questions raised concern the future of important institutions in the city of Nice and very directly the future of nearly 1500 salaried and freelance collaborators.
They deserve a democratic debate to be established between the administration on one hand, and the concerned establishments and individuals on the other.
While a contradictory procedure had been promised, this procedure has just been literally sidestepped.
The conclusions are presented as definitive even before the report is drafted!!

Some claim they have received the Health Minister’s endorsement – still before the drafting of the report – thus disregarding the independence to which the General Inspectorate is attached.

I wish to denounce these outdated methods that are perfectly foreign to a calm and effective Administration of health for the benefit of our fellow citizens.

I want to assure the people of Nice of the unwavering commitment of LENVAL and SANTA MARIA administrators and teams to maintain a private medical service that reconciles management efficiency with quality care.”

“Our establishment operates well to the satisfaction of the patients it cares for. The staff is committed to their work. The practitioners have an agreeable, attractive, and effective working environment with the SANTA MARIA Clinic.

However, the administration wants to dismantle the SANTA MARIA Clinic after authorizing its installation on the LENVAL site a few years ago.
This is incomprehensible and unjustifiable.”

“Regarding the project to transfer the CHU maternity to the LENVAL site, it should be reconsidered in light of the experience gained in pediatric care.

LENVAL has always had a perfect reputation among the people of Nice.

The accumulating difficulties over the past year raise fears of a degradation in the situation for the Santa Maria Polyclinic, which cannot be envisaged in the interest of the patients and pregnant women who visit the establishment by the thousands each year.”
“The doctors and staff expect to be respected first and foremost, meaning they should be consulted by administrative and political authorities on decisions affecting them.
They will strive to be heard in the coming weeks while continuing to guarantee the highest level of quality and safety of care to patients.”
